These Terms of Service govern your interaction with and utilization of the Campaign’s websites, mobile applications, and other online services collectively called the “Sites.” Your access to or usage of our Site implies your consent to these Terms and any supplementary terms referenced. Should you dissent from these Terms, refrain from using our Site.

We reserve the right to amend these Terms periodically. Notification of such changes will be provided through email, notices on our Site, or by updating the Effective Date. Unless otherwise stated, amended Terms take immediate effect, and your continued use of our Site post-notification will indicate acceptance of the modifications. If you disagree with the amended Terms, discontinue using our Site.

Consent to Data Usage and Mobile Communication; SMS Program Terms

Your agreement to communicate with us via SMS, text message, email, or other electronic means is hereby acknowledged. Standard messaging, data, and other rates and fees imposed by your carrier will apply to these communications.

Should you opt into any text programs provided by the Campaign, the following conditions apply:

  • By subscribing to Campaign updates or alerts, you consent to receive periodic updates or alerts via automatic text message. To cease receiving messages, text STOP. For assistance, text HELP or reach out to us via Campaign Support. Message and data rates may apply. Neither the Campaign nor participating carriers assure message delivery. The Campaign reserves the right to discontinue the program without prior notice.

User Content

Our Site may enable you and other users to generate, post, store, and distribute content, including messages, comments, stories, text, photos, graphics, videos, music, and other materials collectively termed “User Content.” With the exception of the license specified below, you retain all rights to your User Content.

Submitting User Content to the Campaign, including through the Site, grants the Campaign and its employees, contractors, service providers, and consultants a nonexclusive, royalty-free, worldwide, fully paid, sublicensable license to utilize, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display such User Content, along with any associated name, username, or likeness, across all media formats and channels, existing or developed in the future, without compensation to you, in connection with the Site and the Campaign.

You are prohibited from generating, posting, storing, or sharing any User Content that breaches these Terms or for which you lack the necessary rights to grant us the described license. You affirm that your User Content and our usage of said content in compliance with these Terms will not infringe upon any rights or cause harm to any individual or entity. Although we are not obligated to monitor, edit, or scrutinize User Content, we reserve the right to delete or remove User Content at our discretion and without notice.

Prohibited Conduct and Content

While utilizing our Site, you are solely responsible for your conduct. You must not violate applicable laws, contracts, intellectual property rights, or third-party rights, nor commit any torts concerning any User Content posted on the Site. You are expressly forbidden from:

  • Utilizing our Site for unlawful or unauthorized purposes or promoting any activities that violate these Terms.

You may only post or share User Content that is non-confidential and for which you possess all necessary rights. User Content that is unlawful, defamatory, obscene, fraudulent, or infringing upon any intellectual property or proprietary rights of third parties is strictly prohibited. Enforcement of these regulations is at the Campaign’s discretion, and the failure to enforce them in certain instances does not relinquish our right to enforce them in others. Furthermore, these regulations do not establish any third-party rights or an expectation that the Site will be devoid of prohibited content.

Ownership; Limited License

The Campaign or our licensors retain ownership of the Site, inclusive of its text, graphics, images, photographs, videos, illustrations, and other content, protected under both United States and foreign laws. Except as explicitly stated in these Terms, all rights to the Site are reserved by us or our licensors. Subject to your compliance with these Terms, you are granted a limited, nonexclusive, nontransferable, non-sublicensable, revocable license to access and utilize our Site for personal, noncommercial purposes. Any usage of the Site beyond what is specifically authorized herein, without our prior written consent, is strictly prohibited, terminates the license granted herein, and breaches our intellectual property rights.

Trademarks

The distinctive logos, slogans, and overall visual identity of the Site are trademarks owned by the Campaign and are protected under law. Without our prior written consent, these trademarks may not be replicated, imitated, or used in any manner, whether in whole or in part. Repeat Infringer Policy; Copyright Complaints

In accordance with applicable law, including the Digital Millennium Copyright Act, we have implemented a policy to terminate the accounts of users who repeatedly infringe on the intellectual property rights of others. If you believe that any content on our Site infringes your copyright, please notify us via Campaign Support. Please note that knowingly misrepresenting such claims may result in liability for certain costs and damages.

Third-Party Content, Products, and Sites

We may provide information about third-party organizations, events, products, services, or activities, or allow third parties to share their content on the Site (collectively termed as “Third-Party Content”). Your interactions with Third-Party Content are solely between you and the third party. The Campaign does not control or endorse any Third-Party Content, and your use of such content is at your own risk.

Indemnification

You agree to indemnify, defend, and hold harmless the Campaign and related parties from any claims arising out of or related to your User Content, Feedback, violation of these Terms, infringement of others’ rights, or misconduct. You will promptly notify us of any third-party claims and cooperate in their defense, bearing associated costs.

Disclaimers

Your use of our Site is at your own risk. Except as otherwise provided, our Site and content are provided “as is” and “as available” without warranties of any kind. The Campaign does not guarantee the accuracy, completeness, or reliability of our Site. We do not warrant that our Site or servers are free of viruses or harmful components.

Limitation of Liability

To the fullest extent permitted by law, the Campaign and related parties will not be liable for any indirect, consequential, exemplary, incidental, punitive, or special damages, even if advised of the possibility of such damages. Our total liability for any claim related to these Terms or our Sites is limited to the amount you paid, if any, to access the Sites.

Governing Law and Venue

Disputes arising from these Terms and your use of the Site will be governed by the laws of the state where the Campaign Headquarters is located. Any disputes will be resolved in the courts of the county where the Campaign Headquarters is located.

Modifying and Terminating Our Site

We reserve the right to modify, suspend, or terminate our Site at any time. You have the right to stop using our Site at any time. We are not liable for any loss related to your inability to access or use our Site.

Severability

If any provision of these Terms is deemed unlawful or unenforceable, it will be severed from the Terms without affecting the validity of the remaining provisions.

Miscellaneous

The failure of the Campaign to enforce any provision of these Terms does not waive our rights. These Terms are intended solely for the benefit of the parties involved and do not confer rights on any third party. Communications between us may be conducted electronically.
